FreshLocal LLC is an online platform that allows users to post and purchase homemade foods, homegrown fruits and vegetables, and meats. We act solely as a venue to facilitate transactions between buyers and sellers and do not produce, sell, inspect, or warrant any of the items listed.

2. User Responsibilities

As a user of the Platform, you agree to the following:

  • You are solely responsible for the legality, safety, and quality of any products you list on the Platform.
  • You must comply with all local, state, and federal regulations, including but not limited to food safety, labeling, and licensing requirements.
  • You agree not to list any prohibited items or engage in any fraudulent, illegal, or harmful activities.
  • You will not use the Platform to engage in any misleading or deceptive practices.

3. Seller Agreements

By listing items on the Platform, you certify that:

  • All products comply with applicable health and safety standards and regulations.
  • You hold all necessary licenses and permits required to sell your products.
  • You accurately represent the nature, quality, and origins of your products.
  • You will not misrepresent any product information, including but not limited to ingredients, source, or condition.

4. Buyer Responsibilities

As a buyer on the Platform, you agree to:

  • Verify the safety, quality, and legality of any products before purchasing.
  • Understand that all transactions are conducted at your own risk and that FreshLocal LLC is not responsible for any product defects or inaccuracies.

5. Subscriptions

FreshLocal LLC offers auto-renewable subscription plans that provide access to premium features on the Platform. By purchasing a subscription, you agree to the following terms:

  • Subscription Title: FreshLocal Premium
  • Subscription Length: Monthly ($4.99/month) or Yearly ($29.99/year)
  • Subscription Price: $4.99 per month or $29.99 per year
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Payment will be charged to your Apple or Google account at the time of purchase.
  • You can manage and cancel your subscription through your Apple App Store or Google Play Store account settings.
  • If you do not cancel at least 24 hours before the end of the billing period, the subscription will renew automatically at the current rate.
  • Refunds for unused portions of the subscription period will be handled according to the policies of the respective app store (Apple or Google Play).

6. Liability Disclaimer

FreshLocal LLC is not responsible for the actions, products, or content of any third-party users or sellers. We do not endorse, guarantee, or assume responsibility for any product listed on the Platform. All transactions are conducted at your own risk. We make no warranties or representations regarding the products’ safety, quality, legality, or suitability for any purpose.

7. Dispute Resolution

Any disputes arising from transactions conducted on the Platform are solely between the buyer and the seller. FreshLocal LLC is not responsible for mediating or resolving such disputes. We encourage users to communicate directly to resolve any issues that may arise.

8. Indemnification

You agree to indemnify and hold harmless FreshLocal LLC, its owners, employees, and affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorney fees) arising out of or related to your use of the Platform or your violation of these Terms.

9. Termination

We reserve the right to suspend or terminate your access to the Platform at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason.
